1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the Watkins Spine website at watkinsspine.com, the Back Doctor mobile application, and any related content or services (together, the “Services”), which are provided by Watkins Spine Center and its affiliated physicians (“Watkins Spine,” “we,” “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Not medical advice; no doctor–patient relationship

The content on the Services is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician or other health provider with any questions you may have regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you read or viewed on the Services.

Using the Services, contacting us through the site, or downloading the Back Doctor app does not create a doctor–patient relationship. A doctor–patient relationship is established only through an in-person or telehealth consultation and formal intake with one of our physicians.

If you think you may have a medical emergency, call 911 or your local emergency number immediately.

3. The Back Doctor app

The Back Doctor app provides general exercise and rehabilitation guidance. It is not personalized medical treatment and may not be appropriate for every person or condition. Consult your physician before beginning any exercise program, particularly if you have had spine surgery, an injury, or other health concerns. Stop any activity that causes pain and seek medical attention. Your use of the app is at your own risk.

The app is distributed through the Apple App Store and Google Play, and your use of it is also subject to those platforms’ terms.

4. No guarantee of results

Patient stories, testimonials, and outcomes described on the Services reflect individual experiences and are not a promise or guarantee of any particular result. Every patient and condition is different, and outcomes vary.

5. Appointments, offers, and communications

Any consultation offers, including offers extended to out-of-state visitors, are provided at our discretion, may require eligibility verification, and may be changed or withdrawn at any time. Scheduling an appointment is subject to confirmation by our office.

Do not send protected health information or other sensitive personal information through unsecured website forms or email. Contact our office directly to discuss your care.

6. Intellectual property

The Services and all content on them—including text, graphics, logos, the Watkins Spine name and shield mark, images, and software—are owned by or licensed to Watkins Spine and are protected by copyright, trademark, and other laws. You may view and use the Services for your own personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works from the content without our prior written permission.

7. Third-party links and content

The Services may contain links to third-party websites, articles, or media (for example, news coverage). Those resources are provided for convenience only; we do not control them and are not responsible for their content, accuracy, or practices. Accessing third-party resources is at your own risk and subject to their terms.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we handle information.

To the fullest extent permitted by law, Watkins Spine and its physicians, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising out of or related to your use of, or inability to use, the Services or any content on them, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Watkins Spine and its physicians, staff, and affiliates from any claims, damages, or expenses arising out of your misuse of the Services or your violation of these Terms.

12. Changes to these terms

We may update these Terms from time to time. Changes are effective when posted, and your continued use of the Services after changes are posted means you accept the updated Terms. We encourage you to review this page periodically.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
